Corporate Rehabilitation / Bankruptcy

The Japanese economy is said to have escaped from a long period of stagnation which followed the collapse of the bubble economy. However, only a limited number of corporations have benefited from the economic recovery. Many corporations have yet to completely escape from deteriorating management amidst the distortions of the Japanese economy in which there has been a growing economic gap between major corporations and small to medium sized enterprises, and a growing regional gap between metropolitan and rural regions. Support for rehabilitation of such corporations, as well as advice to creditors of such corporations forms one of the pillars of our business.

We combine our extensive experience in the corporate rehabilitation of businesses undergoing financial difficulties with our legal, accounting and tax knowledge in order to design and implement rehabilitation plans that are tailored to each client's needs. In many cases, we utilize an appropriate revitalization scheme of the Resolution and Collection Corporation, financial ADR system, Regional Economy Vitalization Corporation of Japan (REVIC) or other means available, for example, under the Act on Strengthening Industrial Competitiveness or the Private Liquidation Guidelines. Furthermore, we often provide advice on organizational restructuring and re-capitalization measures, allowing businesses to strengthen their financial position.

Our involvement in rehabilitation and bankruptcy extends to guidance given to creditors on how to best protect their interests when their business partners incur financial difficulties. We regularly act as legal counsel in rehabilitation and bankruptcy procedures and consequently have obtained a wealth of practical experience as bankruptcy administrators, rehabilitation administrators and oversight commissioners for small and large businesses at the request of the Courts.
